CBS/Paramount sues to stop Axanar

In for a penny, in for a pound. I believe that W&S are looking forward to all the trial coverage on the news networks as well as Entertainment Tonight (if that's still around) and the like. There's no such thing as bad publicity at this point.

I just received an response from the Federal Trade Commission to my earlier Freedom of Information Act request for any investigatory records related to Axanar. Here's what we got:

The FTC has received three complaints against Axanar Productions, Inc., and LFIM. All three complaints were made through the Commission's online complaint assistant. The FTC provided the records to me in spreadsheet form, which I've posted here. The FTC redacted the names, addresses, and identifying information of the complaintants, which I think is reasonable and consistent with the FOIA statute. The FTC's assistant general counsel also cautions that "the enclosed complaints have not been verified" by the Commission. These are merely public records of complaints received.

The first complaint was filed on June 21, 2015, six months before the lawsuit:


The second complaint was filed on September 10, 2016, and relates to the use of Axanar donor emails by Propworx:


The final complaint was filed on October 25, 2016, and refers to LFIM's attempting to censor donors in exchange for receiving refunds:

So the FTC is clearly aware of Axanar. Whether they are going to do anything about it remains to be seen.

Wait, an insider suggested that Alec *bought* a car?

*Bought* a car?? Could that possibly have been hidden by the redactions and missed by CBS? Maybe the wording of the complaint is just too suggestive.

Its very hard to believe. Surely not, one would think Terry or someone would have had wind of such a thing and said something by now. Could a car be bought/leased in the company name and escape being noted in the itemization of benefits? One might just want to check in with Axanar about the acquisition and ownership of that car which has been maintained by the company.

That AP bought a car with donor funds is an allegation going back quite some time. AP's response was to claim that he was still driving the same 10 year old car, and someone on the team backed him up. It was in one of the Facebook pages, can't remember which.

That 10 yrear old car is a Lexus, but hey. 10 years.

Wouldn't it be the time for all fan film producers to gather at the round table and prepare a common statement where they all distance themselves from Alec Peters' actions and behaviour?
Or is it not that time, yet?
I'd guess that would even isolate Slow Lane's blogging tendencies... or make them even more "transparent".

On a more serious note, I think it's a common opinion here the Axanar, LFIM et al are pretty much screwed. Other than just shutting up and going into hibernation for a while, I wonder what he'll (Slow Lane) do when the courts come down against the defense??? (am sure he'd spin the hell out of a partial victory - any circumstance where Axanar/LFIM doesn't totally get nailed)

I'm sure they already have. I recall all the higher profile ones publicly siding with CBS.
 
Had there been a fifth season of Enterprise, we would have learned that a pie emergency triggered the Earth-Romulan War.

Honestly, why would he settle? As long as his lawyers continue to enable him, he has no reason to put an end to this. In theory he could keep this case tied up in appeals for a couple more years. And any monetary judgment can be disposed of in bankruptcy. The only thing that would prompt a settlement is fear of imminent regulatory action (e.g., FTC or California Attorney General).

Yeah, he's playing with house money for the case. And if W & S didn't get a clear agreement with him about limitations on the case, or not handling the appeal, etc., then that's on them. Certainly they should have (although they probably thought the matter would have been wrapped up before summer ended).

I have seen a new associate's name on filings, which could mean associate pro bono billing hours are done for the year (probably for Kelly Oki). Not a huge issue, as I bet the clock resets in January, although that does give an idea of at least how many associate hours are going down this particular drain.

PS I agree a pie emergency triggered the Earth-Romulan War. Sweetie, I smell a fanfic!

The "Annual Report" which confusingly covers a 16 month period of 4/1/14 - 7/31/15 shows an expense line item for "Auto" in the amount of $9,163.62. So yeah, that's enough to lease a car or two ($572.72 a month). You tell me.
 
Yeah I finally broke down and read the defense zip files. I had read the plaintiff files earlier. Is it just me or does the noose seem to be tightening? The defense actually includes some stuff that I would have NOT wanted to draw attention to. However, I am NOT a lawyer "by training".


Unfortunately, Ranahan has been able to keep unreacted documents clearly spelling out where the money went, out of the public eye. She's stated people like us / the CBS v Axanar group are the reason she wants it kept secret, for fear of embarrassment to Alec. There's some evidence the judge is getting skeptical of that reason, but he still allowed it this last round.

My take away is that Alec managed to burn through $1.4m of donated money with only half completed sets, a warehouse that still hasn't been able to be permitted for use as a studio, and 50 minutes of VFX for the final movie.

As someone who has made several movies, I'm completely gobsmacked by how he's burned through this money.

It's breathtaking isn't it? There's NO WAY he blew $1.4 million dollars on that studio buildout and those half finished sets. Where's the money??

The majority of them already did that when Alec Peters tried to get them to back him in 'discussing/proposing' Star Trek fan film guidelines around the time that CBS announced they were working on and would release the guidelines that they ultimately did.

I'm sure Mr. Lane will continue to Blog in support of Axanar (he is 'employed' by Axanar as a "Writer") by his own sworn declaration) should Axanar prevail (unlikely) or attempt an appeal of an y Judgement/Verdict against them.
 
I'm sure that includes green-screen walking shots and other scenes they don't have standing sets for, like we saw in that Vulcan "teaser", which was all VFX. It doesn't necessarily imply that it would all be exterior space battles & the like, although I'm sure there would have been quite a bit of that too, considering the subject matter.

I'm still very sad that we'll likely never see a finished product. Before it all collapsed under the weight of the AP stupidity, it really looked like it held promise. :(

I truly believe that he though they could use this money as his own personal cash supply and just continue to raise (steal) money from the fans to finance his lifestyle and maybe get around to making a film someday.
