CBS/Paramount sues to stop Axanar

Not open for further replies.
I'm guessing Peters is going to find it difficult to ever raise money on Kickstarter or Indigogo ever again.

During the FTC forum, I believe it was the Kickstarter representative who said the company was making more of an effort to screen for potential scams. Specifically, this was in reference to products--i.e., requiring an actual prototype before permitting a campaign to open--but I imagine the LFIM and Gerrold incidents will lead to greater scrutiny of any creative project without documents IP clearance.

Basically, their shills have moved on to trying to cover their asses against potential legal action by the defrauded donors.

Axanar is done and everyone in Der PetersBunker knows it.

There's a lot of wild conclusions being jumped to based on misunderstanding, limited information, and rumormongering, by both well-intentioned donors who have questions, and malicious parties pursuing their own personal vendettas. It's understandable that people are upset. Regardless, the risks were stated up front, and nobody was forced to donate. As long as the producers endeavor to produce the film within the scope of their abilities and resources, there has been no fraud committed. Since CBS and Paramount chose to sue, any delays caused can be attributed to their litigation. If that depletes the funds to the point that completion is impossible, then again, that was part of the risk assumed by the donor. Clamoring for class-action lawsuits may feel good, but if Axanar loses the lawsuit, there will be no money left to recover, even if there were good grounds for a class-action suit. Realistically, at this point, there's nothing to be gained by all this trolling and shouting. All we can do is await the outcome of the trial and any appeals.

Last night, I posted this here and also did a post with these two e-mails on the KS Comments section (around 12:15 AM this morning:

http://www.trekbbs.com/threads/cbs-paramount-sues-to-stop-axanar.278077/page-1314#post-11834977

I've been posting in the Comments section on the Axanar Kickstarter page; and I guess Alec Peters finally got annoyed enough to send a personal reply:

Just because something is in a court document filed by the plaintiffs doesn’t make it true. We clearly sent them the financials that prove I didn’t take a dime.
But believe the lies. Believe the things that fit your world view and ignore the truth. Just pissing me off so I will never refund your money.

I of course decided to send a response:

Considering it's referencing your sworn deposition; I trust it more than any spin you try to put out.
Also it must really gall you to realize just how SMALL your actual contribution to Prelude was. The professionals involved did an amazing job most likely in spite of you more than because of anything you did.

I'm an idiot for not really checking into your background prior to Pledging so yeah that's on me and $75 is at best one nice night out (and more than likely you spent my donation on Sushi at some point.)

Overall for me it's not a big deal but I just find it interesting how far you'll continue to go to avoid the real truth that deep down you're just a crook and con man and a true dishonest and disingenuous person. That's the real truth about you Mr. Peters

So yeah hope you enjoyed the Sushi. Doubt you'll be able to afford a can of tuna when the court case is finished though.

Petty on my part?

Maybe, but I just can't stand raging egotists.

I thought it would be the end of it but hilariously no, it wasn't. I'd like to share the following e-mails from Alec Peters to me that I received at around 8:30 AM this morning (which was 8 hours or so after I posted the first exchange publically):

E-mail #1 from Alec:

Well I read 117 “facts” and half of them were outright wrong. But you are so brilliant, I am sure you know better.
Actually I created Prelude, It was my story and I wrote it, I produced it, I raised all the money for it with no help. I acted in it, I helped edit it, I got the composer, and when the director couldn’t do most of the work he was supposed to, (because he is a massive flake as I have found his reputation is) I had a team who could pick up his slack. But yeah, I had a “SMALL” role.
Tell you what, I will give you a refund just so you can claim a victory, because by your attitude, and what you spend time on, you need it in your life. Expect your refund later today.
Alec

E-mail #2 from Alec Peters: (Which has the refund made to Pay-Pal - but as I used a credit card I have for on-line purchases and have never gotten and never will get a Pay Pal account because I don't see the need - I was never going to claim anyway):

And finally, my reply (just typed and sent) to Alec Peters first e-mail:
To
<e-mail address redacted>

Hi Again Mr. Peters:
Wow, I never have laughed so hard at an e-mail reply in my life, so I thank you for that as it made my morning.

As for the substance of your reply, boy I have to admit, you really must be smoking some good shit as it's amazing that (after reading the e-mails between yourself and Christian Gossett - which were made part of the public record due to the court case) I really find it interesting that somehow a Hollywood Industry professional such as Mr. Gossett

- Who was in fact the one that attracted some other major talent (including Tony Todd and the makeup people who did a hell of a job BTW.)

- Got you in to an actual professional rented studio to film principal the principal photography of Prelude

- Directed the 'Prelude to Axanar' vignettes.

And he HAS an actual Hollywood production track record.

Funny how as soon as he started calling you out in an e-mail (for you lack of commitment to the follow up 'Axanar' feature film, which BTW has what? 2 minutes and 40 seconds completed after two plus years (and you had about 18 months to work and get Axanar in production BEFORE the lawsuit was filed - but yeah, nothing. Just what were you doing for those 60 hour work weeks you claim? Maybe you should have followed his advice and RENTED a ready to go soundstage in January 2015 instead of signing a three year lease and attempting (and by all accounts failing) to get it up to code for use as a soundstage.

One also has to wonder IF 'Axanar' was in fact your goal - instead of maybe (oh I don't know) using funds PLEDGED for that project to create a new for profit business venture for yourself (and somehow resurrect and re-start you failed/bankrupt 'Propworx' company. Not to mention a Donor store with unlicensed Star Trek merchandise and Star Trek Coffee of all things.

Also, amazing that when Tony Todd leaves the project (something you fail to inform Backers of for months); suddenly he's the money grubber who bailed on Axanar. Hell, his name alone probably got you more Pledged funds than anything you personally have done and it's no wonder AFTER he left you continue to use his image to promote the project.
And what about Mr.Tommy Kraft - the other person (aside from Tobias Richter) who REALLY made Prelude what it was. Your treatment of him (and his own MAJOR accomplishment - the FULL LENGTH Star Trek fan film 'Horizon'); after his fan fil garnered more views than Prelude was just petty and honestly shameful. Hell, because of your actions he was unable to proceed on a sequel to 'Horizon'.

One has to wonder if your projecting your own personal faults on other people in an attempt to convince yourself your just a 'innocent victim' and thus be able to live with yourself...quite sad actually.

Yes, Mr. Peters you've done a lot for the Star Trek fan film community (which you ironically didn't really like to admit that Prelude or Axanar, or yourself was a part of UNTIL you were sued for using Star Trek copyrighted material for personal financial gain.)

And, sorry sir, taking a Salary IS 'financial gain' as are gas, tires, food, travel expenses and entry fees for film festivals, sponsorship of awards Prelude received, etc. Now that you attempt to claim you 'paid back' the money [and no I don't believe that was in fact the case anyway] I really laugh as I'm sure the IRS may if/when they audit you. taking a zero interest personal loan is illegal. It's like a bank robber showing up the next day after robbing a bank and NOT expecting to see criminal charges.
^^^
Yes, because of your actions, a situation where CBS/Paramount pretty much 'looked the other way'; and allowed fan film makers free reign in many areas was destroyed.

The other thing I find interesting is how you yourself tried like hell to get CBS to take legal action against other Star Trek fan film makers over the years just shows a high level of hypocrisy on your part as well.

Lastly, regarding the refund and your redaction of it 30 minutes or so later because 'someone posted about it' - (and yes, I did post our earlier e-mail exchange; but that was a good 12 hours before the e-mail I received from you at 8:30 AM today)
- I don't think it makes us 'the children' here. For someone who likes to claim he's 'transparent' - you sure like to attach strings to everything you do, and it's always the same string: "Post anything in public, and the deal's off" - yep, very 'transparent'.

PS:
While I wouldn't have taken the refund myself (I pledged with a credit card I use for online purchases, and have never had nor wanted/needed a Paypal account and prefer to limit my online presence in that regard.) I actually wouldn't have posted this publically because I don't know the financial situation of the other two and $75 might actually make a difference to one or both of them - bit again I think it's a real display of your TRUE character when you tie any refund for one person to the actions of another. That said, whether or not you decide to give refunds or not, there's no feeling of 'victory' for me one way or the other. I also don't spend a lot of time worrying about what others think (Yourself included).

You also must have amazing intuitive powers to also know what I spend my life on from a couple of e-mails and posts. Hey, maybe you can make a new career of that as I hear Phone Psychics are in demand in some areas of the country.
Believe it or not, I've had a lot of fun this morning. Also very much enjoying my vacation.:rommie::shrug:;)
