CBS/Paramount sues to stop Axanar

Ya know, the funny thing about this is, and I didn't even catch this when it was first posted... The way the first note is written, it seems to suggest that he would call the police to file lawsuits. Well, any Attorney would know you don't call the police to file suit. You call your attorney and they write up a complaint. It is then filed in Court along with a filing fee and then it is served.

Nevermind the issues of cross jurisdictions with the fact that Alec is in Los Angeles, you're in Carolina, his godchild is somewhere in Florida and Facebook is a Deleware corporation with headquarters in Menlo Park. The only way Peters could sue you is if you (1) agreed to be in the jurisdiction that he filed the complaint in or (2) the Court found a reason to bring the long arm statute on you.

There is a test for long arm jurisdiction that courts tend to follow:
  1. What is the burden on the defendant?
  2. What are the interests of the forum state in the litigation?
  3. What is the interest of the plaintiff in litigating the matter in that state?
  4. Does the allowance of jurisdiction serve interstate efficiency?
  5. Does the allowance of jurisdiction serve interstate policy interests?
Regardless, his complaints against you personally are certainly not those a Federal Court would wish to hear, as its barely a case at all. And as suggested above, a California Civil Court would likely not find reason to pull you who's made some comments on the internet into trial. Him going to Carolina would be extremely expensive. So ultimately, it was a pretty toothless threat. He'd have more luck taking you in front of Judge Judy. You didn't know that at the time, for sure. Just next time he tries to threaten, you can always shoot down his argument pretty quick.
 
Oh, I knew the odds of anything legal happening were zilch, but I didn't want to be a target. Since I was doxxed the day before, it was time to close shop (and my attorney wife told me to). Essentially, I was the teacher of a boy who punched another boy after school. I don't think in loco parentis extends to Facebook admins in the middle of the night.

Thanks for the legal summation though. Nice to have my thoughts confirmed.

Peters keeps bringing up the whole house thing, but I don't see how Squiggy could be responsible for that. You just happened to be the guy who started the Facebook group, I don't see how you could be responsible for somebody who you have no real connection to.

I hate to be this way, but for those of you who have had one on one run ins with Peters, is he the one initiating contact, or are you guys sending him messages? Becuase if you guys are sending him antagonistic messages I kind of can't blame him for responding in kind.
I'm not trying to take his side here, I just want to make sure I have all of the facts.
 
Peters could have been a big shot. Think about it for a moment -- let's say he kept his original intentions and produced the original fan film version of Axanar in, what, 2012? 2013? Like he originally planned? He made a damn fine fan film and then had something to show producers and studios to get on and say, "Hey! Look at what I did on this budget." Instead, he got too big for his britches and so did his idea. Had he done what he set out to do initially, we wouldn't have this thread right now.
 
So Alec Peters' claim that 1701 News quoted him out of context and that editor-in-chief Michael Hinman cut up his quotes after the fact in order to make Peters look bad turns out to be untrue. 1701 News has published all of Peters' quotes, in their entirety, and will shortly make the audio recording available, too.

LOL - I'm going to enjoy Mr. Peters response to this (assuming it happens; I don't expect 1701 News wouldn't release the audio but as they haven't yet, just trying to be fair). I'm sure Mr. Peters will somehow claim the audio was edited to make him look bad, etc. but we'll see.

Posted the above before reading the rest of the thread to this point. IMO - disappointing the audio of the interview won't be publically released (I do understand why); but, I do like that you guys were smart enough to make it (and honestly, Mr. Peters is an idiot if he knows he was recorded, yet now makes claims things were taken out of context) in case the lawsuit threatening Mr.Peters ever did decide to try and sue for libel/slander.

I never sent him anything nor have I ever posted anything on any of his fan groups. What I posted is the entirety of our communication with each other.

That's not even including his little henchman's threats the week before. Terry got all uppity because people were saying mean things and he couldn't control the message.

Funny that his ventures seem to implode around the $1.2 million dollar mark. :lol:
 
Its his magic number.

It is pretty impressive if you think about it. He went bankrupt owing MGM $300,000. Screaming Sports simply disappeared after he raised $1.2 million and he's raised $1.2 million with Axanar. He's bilked people out of nearly $3 million dollars.

How interesting. I wonder how many of his supporters know about that failed company? Reading over the blog posts... he sounds the same 8 or so years later. :lol:

And that's what it comes down to.

Look, this is a crazy situation, and sadly, a reporter was caught in the middle of all of it. He's never had a story like this before, and people think they are easy to write (and then easy to defend in the social media sphere we all live in). I mean, hell, even this thread has taken potshots at me, including one thing from 15 years ago.

But as I told John, even if the first draft had been published ... you can see what the quotes are in the follow-up column I did. They are not much different. Yes, some were trimmed (as happens in editing), some were not even included (like, "Paramount started this," and "Tony Todd is greedy") primarily because they just didn't fit in the overall story, or the Paramount comment was so wrong that it would've been too distracting to explain the reality (Paramount is more than just a licensee, and Peters implied ... a licensee would not be a party to such a case, no more than Creation Entertainment, as a licensee, would be a party).

But anyway, I just went on a tangent in the last paragraph, lol! But even if the first draft had published, Peters would still kick up a fuss. The only way he wouldn't is if he controlled the story, made whatever changes he wanted, and then had approval over the final copy. But that's not a news story -- that's a press release. And we're not a PR company. Not even for CBS and Paramount.

And then once these quotes created a backlash, he would've attacked anyway.

Peters does not know how to take responsibility for his own actions. In the conversation he had with Squiggy above, he claims that he was "doxxed." Yet, this was so egregious that someone revealed this home (which they didn't ... it was the "corporate address" for Woodland Terrace Investments, a company he created in February 2015 (nearly two years after he bought the property) that was never transferred as owner of the property, which would have matched Peters' claims that the company was made to protect that particular asset.

If the address of this house was such a secret, why did he use it as a corporate address for his company that he created a year ago, on a document that he knew was public record? I have kept my home address a secret for many years (although it was bound to get out). And once I used it on a public document that someone found and shared with others. But did I get mad at that person? No. I was mad at me, because I shouldn't have put it on a public document to begin with.

He wants these posts taken down, not because of some fear of his "godsons" being exposed (for someone who is afraid, he sure brings it up a lot now), and every time I mention "Woodland Terrace Investments" as a company he created with a Propworx employee and credited Axanar crewmember in February 2015, around the same time he was raising $1.1 million for Axanar (without linking to any of the public documents he filled out), he then tries to privately have those threads removed. Either with threats like he did with Squiggy, or with little things like, "Oh, let's piss off Hinman, and remove that entire conversation" to someone in private message.

I was trying to give him the benefit of the doubt on this one ... but he has effectively shifted the conversation to his "godsons," and made people forget that there was another question on the table. What is this investment company? Why was it created? If it was for a property you own in Florida, why was the property not transferred to that property (which would be necessary in order for it to "protect it" -- it's like buying condoms because you believe in safe sex, but never use them during sex)? And it's been a year since the company was formed. And as of today, there's still nothing indicative in public records that this company is the new owner of the property.

Maybe Peters just doesn't understand how this "form a corporation to protect a physical asset" works. That is very possible. But the way he has distracted the conversation from this company to how I'm "doxxing" him, the way he is trying to get any mention of Woodland Terrace Investments I make removed (either with threats, or the buddy-buddy at the bar), and the fact that what he says about it has yet to line up with the facts ... that's disturbing.

How hard would it be to change it over? As hard as submitting a couple of forms to the Orange County government, paying a small tax, and that's it. It's a quitclaim situation. And in the past year? Never been done.

Sorry if that's a bit tangential, but since there was a conversation that mentioned me, I wanted to address it. :)
