CBS/Paramount sues to stop Axanar

I could see how you might be able to get away with the coffee if 100% of the sales went to fund Axanar as your purchase is little more than a donation, but even the Axanar Coffee website says:


"Help us fund the Axanar full-length feature film by purchasing Axanar Coffee. A portion of the sales price goes directly to the film-makers of Axanar."


A portion? A portion?!?!?! Well where the hell does the rest of that portion go to... oh right, a functioning, for profit business (Hansa Coffee)

That is so beyond delusional... Wouldn't the Klingon logo emblazoned on the coffee bag be owned by CBS... "Andorian Ice" you might get away with, but the D6 on the bag, and the rest of it are more than highly questionable uses of the Star Trek license.
Yeah, that's crazy. Every other Star Trek fan film would readily admit they are using someone else's IP. For Axanar to even feel the need to deny such a thing is absurd. And over what, selling coffee? How did we even get here?

Indeed. This has been my point for days. It's a commercial enterprise that trades on the goodwill of the Star Trek brand, no more, no less.

And the trip of it is Alec Peters freely admits he's using CBS/Paramount IP in the FAQ of his Axanar home page.

Is Axanar licensed by CBS/Paramount? No, Axanar is an independent project that uses the intellectual property of CBS under the provision that Axanar is totally non-commercial. That means we can never charge for anything featuring their marks or intellectual property and we will never sell the movie, DVD/Blu-ray copies, T-shirts, or anything which uses CBS owned marks or intellectual property.
Those coffee bags are $15.95 a pop so Alec's argument he isn't charging for IP that doesn't belong to him is a lie.
 
Hansa Coffee Roasters, based near Chicago, have their logo on the bags of Axanar coffee. Couldn't that mean trouble for them, too? Wonder about the details of the agreement between Hansa and Axanar. Did Axanar ship them labels and the coffee was bagged and labeled by Hansa? Also, doesn't this make Axanar a retailer of Hansa coffees? Their prices are within a dollar or equal to the prices on the Hansa site. A portion goes to the film, probably the difference between the wholesale price they paid Hansa (with crowdsourced money, no doubt) and the retail price. So, the profits from the sale of the coffee go to the movie. At least that's how it looks to me.

In any case, it might be a good idea for the good folks at Hansa to talk to a lawyer. Soon.

You know, I still can't fathom why a 20 min talking head greenscreen short film and one 3 minute Vulcan scene is greeted (to the axanauts /axanorks or whatever they are called) like the second coming, that Peters etc "get" Star Trek more than anyone else.

It was okay. Not outstanding but okay. The Fx looked good but surely that's Tobias Richter. Am I the only one that thought the costumes looked cheap? And that Richard Hatch looked ridiculous? :wtf:

Don't watch a lot of fan films but much preferred all the New Voyages / Continues stuff.

If Paramount / Cbs wanted to shut down those guys I could at least understand the anger. They would be shutting down something that actually exists. :D

That's not a "take", that's fact.

So let's say each 1 pound bag of coffee costs Hansa $7.95 in actual product, packaging, and labor to produce. Then I suppose they could give all $8 per bag, beyond their cost, to Axanar as the "donation" part of it. That way there's no "profit" involved in the transaction, but that's not what the disclaimer is really saying.

I don't think where he spent the money is at issue here... I mean as of now, Axanar Productions is still a domestic stock corporation owned by Alec Peters... How much in assets was he able to amass in that corporation... I just wish that there would be some movement on the injunction...

This all happened just a few weeks too late, or I might have gone and tried to interview them or something. Unfortunately, I moved out of the Los Angeles area a few weeks before Christmas. ;)
