scans_daily's mods DID do their "jobs" in setting a limit at 50% or less of any book could be posted.
It doesn't take a law degree to know that posting *half* of a comic or any other work is infringement. What it takes is common sense.

Look, I don't even give a shit about this situation and whether he or Marvel or whoever was "legally right" or not. He's still an asshole...IMO.
You claim not to care, yet you call him that based on... a guy doing what's right?
No, I'm basing it on plenty of other things the guy's said that I feel no need to go over with you. So sorry.

There's nothing dishonest about saying, "I let Marvel know that someone was violating their copyright, and I didn't do it with the intent of getting the site shut down or to have the images removed."
So what did PAD think might happen? Are we now to the level of saying PAD is either incredibly naive or amazingly dumb? We know he isn't, and that's where the dishonest part comes in. PAD is asking us to swallow that he sent this innocent, objective notice to Marvel legal never realizing that it might cause the site to be torn down. As you would say, "bullshit".
PAD never said he never thought that it could get SD shut down. He said that he didn't do it with the intent of getting Scans_Daily shut down.

You DO understand the difference between claiming that you didn't have a specific intent and claiming that you're unaware of a possible consequence, right?

^^ What WAS his intent, then?

If he had just come out and said what they were doing was wrong, and he reported it, that would be fine. It's the backtracking he seems to be doing now that makes him look bad.

David has written multiple times on his blog that his intent was to let Marvel know that their copyright was being violated. Is it really so hard to imagine he had no other intent than to simply make sure the copyright owner knows what's going on with their property?

I'll agree that posting half a book is excessive, but I don't agree with PAD on the issue of written summaries. No matter how detailed, I'd say that was fair game.

what I noticed from my using the site is that the majority of the books that had excessive pages scanned were from very old issues (like mid-90's and back) and stuff thats never been available on trade or OOP trades(like the Batman the animated series comics). I had a hard time finding more than 5 pages of the more recent stuff (2000's and on) and the more current stuff were usually scans of the 8 page previews you can already find on places like Newsarama...Then again I havent been using the site for very long, I ony discovered it a couple years ago...but anyway that's why it was so useful.

I came across something by happenstance reading reviews on the x-axis blog that he was begging people not to give away plot details of X-Factor 39-40 so maybe that set him off extra hard.

One rather ironic part of the whole thing is that the s_d mods were due to roll out new, far stricter rules drastically reducing the percentage of a floppy which could be scanned within the next couple of weeks.
Damnit, it's not a floppy, it's a comic.

That's what all floppy buyers say - us trade waiters aren't fooled...

So because stuff is older and hard to find, it's OK to put it up on the internet?

Lol. That's hilarious. No giving away spoilers on the net? G'luck with that, PAD.

Is it difficult to imagine that he would have no reason to expect that Marvel would take some action? Yes, yes it is.

Expectation is not intent; please do not move the goalposts.

Please do not obfuscate by pretending that importan distinctions exist where none do.

Old robot story by Asimov had one of the characters wondering whether the part of that Robot Law about harming humans - the part that said a robot "could not through inaction allow a human to come to harm" - was important. The other character pointed out that without it a robot could drop a heavy weight from height on to a human being fully knowing that it was fast enough to rescue the human - and then after dropping the weight just change its mind about the rescue. Of course, that's ridiculously compartmentalized reasoning...
