I don't have an on-line source for this, saw it last night on "Countdown" at the end of the show. The charges against Christian Bale have been dropped. No evidence. Prosecutors even voiced that something seemed fishy with the whole thing -- like so many of us said. So all is well that end's well.
I think it was to do with his mum and sister being raging drunkards (you know, alcohol turns people temporarily incoherent and sociopathic).

He got it from Countdown and guest host Rachel Maddow admitted it was a bad pun, but she "had to do it."
I'd say it was dependent on context and surrounding situation. I say threatening behaviour is just that, and not really assault, but probably down to emotional resonance rather than actual legal definition of the words.
