I think 9 and 10's guilt over the Time War still works if Hurt did it. Hurt is still the Doctor even if the others don't want him to go by the name. They still have to own up to his actions because he still is them.

As gets pointed out every year when people start whinging about Comic Con, BBC America pays for everything so no it doesn't cost License Payers anything.
