It's Finnegan. Since Kirk didn't go to the Academy at the same time as Finnegan in this reality, there was no one to keep Finnegan's bullying in check and so he escalated to interstellar terrorism.

That is true. In Enterprise Arik Soong and his Augment "children" discussed how the Botany Bay was just some legend that had no evidence to ever substantiate it. Soong thought the story of the Botany Bay and Khan was complete bullshit.

Until Kirk and his Enterprise found the ship over 100 years later Khan had been thought to be long dead, possibly as far back as his defeat and exile at the end of the Eugenics Wars.

I'm absolutely sure that John Harrison is how we and the other characters will be introduced to him in the beginning and at some point who he really will come to be known to us as will be revealed.
