Yes but as you yourself admit he gained an advantage by exceeding the track limits. If that rasied kerb extended all the way to the end with no gap, would he have held position? Or would he have had to slow down thereby losing the lead?
When Hamilton did the same thing, he did the correct thing and yeild position back to Rosberg otherwise he should have got a 5 second penalty. Sure in retospect you could say he shouldn't have and they couldn't give him a peanlty because they didn't give Rosberg one for a similar incident.
