Kirk was made acting first captain and spock captain when he went to Nero's ship. As soon as the scene was over and spock and Kirk got into an argent about what to do next, spock ordered Kirk off the ship. The others knew that Kirk was first officer so why didn't anyone protest captain spock throwing their first officer being made a prisoner and being thrown off the ship? It doesn't make sense to me.
A captain is allowed to relieve the first officer, if other Trek is to be considered. We've seen it time and again. Kirk was going to get tossed in the brig after assaulting security officers on the bridge. Then Spock figured "fuck it" and threw the headache off of his ship.
Or Spock honestly thought that Kirk was going to the brig, and it was "cupcake" that made the decision to toss Kirk into that lifeboat.
Spock had just witnessed his home destroyed and his mother killed, he obviously wasn't thinking straight. And besides, Kirk wasn't even supposed to be on the Enterprise to begin with, and he was left on a planet with a Federation outpost on it anyway.
The Captain has discretion for conduct aboard their ship. If they feels an officer is a disruptive influence, then they can relive them of duty, confine them to quarters, place them in the brig, or remove them from the ship. The only person a Captain would have to answer to is their superior officer and justify his actions.
Not quite. When Kirk was recording his log after landing on Delta Vega, he noted that by abandoning him on the planet Spock was in violation of Starfleet regulations, which he intended to report Spock for when he got in contact with Starfleet again. Presumably he didn't follow through on that.
Exactly! The first officer is there to protect the ship and crew incase the captain outs them in danger. In next gen timer had to get the senior staff to agree the captain was not fit and putting the ship in danger when he was replaced with an alien when Picard was trapped with 3 others in a room for study
That's a fair point, though Kirk stated that he believed it was a violation of regulation regarding the treatment of prisoners. But, Spock was emotionally compromised and that scene showed that. Regardless, captains are given broad discretionary powers, and generally speaking, have to answer to only their superiors about their decisions.
We might consider the people involved, too: we learn that Kirk knows his regulations, and Spock no doubt knows them, too. But Pike's decision to rely on these two goons shows the ship was really short on experienced professionals from the get-go. Who else aboard the vessel would be in a position to quote regulations on Spock? The Security team would be specifically trained in the subject of regulations, no doubt. But they hate Kirk's guts already; their current boss is about as raw a recruit as Kirk himself is; and whatever Spock did wrong, it probably was a minor formality rather than a major violation of basic rights and procedures. McCoy might side with Kirk here. But the poor Doctor is unlikely to know the finer rules, and can't throw the book at Spock, not before going back to his cabin and reading it anyway. Sulu could be pals with Kirk by now, but he's seeing two officers behave in a fashion unbecoming of an officer. He has to pick one, and Spock has more braid on his sleeve. Chekov... Is a kid. Ultimately, I doubt there was much wrong formally with what Spock did - but stranding Kirk in a life-endangering way doesn't sound like something covered by the regs. What I suspect is that the ever-resourceful Kirk tried to tamper with the lockout of the lifepod while on his way down, and ended up misdirecting the pod to the icy wastes when it was supposed to soft-land next to Scotty's outpost initially... P-Kirk marooned Gary Mitchell on Delta Vega. P-Spock''s solution was to kill him. I think K-Kirk got off easy.
Gary Mitchell was a genuine galactic threat IIRC. NuKirk was just an uppity delinquent type as far as Spock was concerned. It'd be one thing depositing him on a shuttle but I guess that just doesn't give us as good a window for the tidal wave FX.
